Warranty Statement

This warranty contains all of the Piranha obligations and any distributor and the agents, officers and employee of such distributor and of Piranha are not authorised to vary or extend the terms of the warranty. The benefits conferred by the warranty are in addition to the Australian Consumer Law- Consumer Guarantee, which apply only to the extent which they may not by law be excluded.

Australian Consumer Law - Consumer Guarantee

'Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  1. to cancel your service contract with us; and
  2. to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service’.

Exclusions

This warranty shall not apply to, or include, any of the following: Any defect or failure due to accident, misuse, abuse, relocation to another vehicle, negligence, non-observance of any of the instructions supplied with the Product on the part of any user, choice of location, improper installation, configuration or connection to a vehicle with an electrical fault If the Product is installed, repaired, serviced or tampered with by a person who is not qualified, or if non-approved parts have been fitted Failure to obtain proper maintenance for the Product or any associated equipment on the vehicle If the Product is used other than for any reasonable purpose for which it was manufactured, or is used in a way not specified by Piranha If the original purchaser sells, leases or otherwise parts with possession of the Product. ie: internet sales, second hand goods Any freight, packing and insurance expenses relating to transportation of the Product. Any expenses relating to installation and/or removal of the Product. Any damage, indirect or incidental, of whatever nature. Failure to pay for products in full.

Limitations

To the extent permitted by Australian Consumer Law Piranha is not liable for any consequential, indirect or accidental loss or damage or for any service not expressly provided herein (including without limitation liability for any loss or damage caused by a fault in the Product or its external wiring connections) and the liability of Piranha under this warranty is limited to the repair or replacement of defective material or workmanship by a qualified person, provided such person and work is approved by Piranha prior to commencement.

Other Claims

Piranha Offroad will not be liable for any scratches or damages to the vehicle where the vehicle has not been cleaned or is in a dirty condition on arrival at our premises. Piranha Offroad will not be held liable or responsible for any tub remaining after a tray has been installed to our customers vehicle on our premises. All tubs are the responsibility of the customer and need to be removed from our premises at the customers expense within 24 hrs of the job being completed, failing which the tub will be disposed of from our premises.

Owner Responsibilities

Maintenance of the Product and associated equipment is the responsibility of the owner. The owner must retain evidence that proper maintenance has been performed on the Product by Piranha or a qualified auto electrician or electronic technician. Claims made during the warranty term will not be accepted if resulting from lack of maintenance rather than faulty material and workmanship. The owner must operate the Product in accordance with all of the Operating Instructions. The owner must return the Product to the distributor as soon as possible upon discovery of a fault with full details of the nature of the fault. (Removal of the Product must be done by a qualified person to ensure that the warranty remains valid.) A written report describing the circumstances of failure must accompany the returned Product with proof of purchase which clearly shows the date of such purchase by the original purchaser. If the Product is found to be satisfactory on return to Piranha, we reserve the right to apply a charge for testing, assembly, reassembly, packing and freight. In most cases no fee is charged for standard testing.
